Tool to avoid potential liability through a written agreement with ADEQ, which provides a covenant not to sue for any potential Water Quality Assurance Revolving Fund (WQARF) and state Comprehensive Environmental Response, Compensation and Liability Act of 1980 (CERCLA) liability for existing contamination - if certain statutory conditions are met.
